Terms of Service
Effective date: August 15, 2025
Welcome to Cal Expert. These Terms of Service (“Terms”) govern your access to and use of Cal Expert, including our mobile apps, websites, and related services (collectively, the “Service”). By using the Service, creating an account, starting a trial, or purchasing a subscription or other paid feature, you agree to these Terms.
1. Contracting Entity
These Terms form a legally binding agreement between you and DAOWEI NETWORK TECHNOLOGY PTE. LTD. (“Company,” “we,” “us,” or “our”), the operator and provider of the Service. Any references to “Cal Expert” refer to the Service provided by DAOWEI NETWORK TECHNOLOGY PTE. LTD.
2. Eligibility & Accounts
- You must be at least 13 years old (or the age of digital consent in your region).
- When creating an account, you agree to provide accurate information and to keep your credentials secure.
- You are responsible for activity on your account.
3. Health & Safety Notice
- Cal Expert does not provide medical advice and is not a medical device.
- Nutrition and calorie estimates (including AI-powered results) are for informational purposes only and may be inaccurate or incomplete.
- Always consult a qualified healthcare professional for medical questions, diagnoses, or treatment.
- Do not use the Service in emergencies—contact local emergency services immediately.
4. Subscriptions, Trials & Billing
- Some features may require a paid subscription. If offered, free trials convert to paid plans unless canceled before the trial ends.
- Subscriptions auto-renew until canceled. You can manage or cancel subscriptions through the platform or checkout flow where you purchased them.
- Prices may change with prior notice where required. Taxes may apply.
- If you purchase through an app store, refunds are handled by the app store through which you purchased (e.g., Apple App Store or Google Play) to the extent permitted by their policies.
- If you purchase directly from us through a website or other checkout page, payment may be processed by our payment providers, including Stripe. By submitting payment information, you authorize us and our payment providers to charge the applicable fees, taxes, and renewal amounts.
- Direct-purchase refunds, cancellations, chargebacks, and billing disputes are handled according to these Terms, the checkout page, and applicable law. Unless otherwise required by law or expressly stated at checkout, fees for paid periods already started may be non-refundable.
5. Payment Information & Fraud Prevention
- You agree to provide accurate billing, contact, and payment information and to keep it up to date.
- We may refuse, cancel, or suspend transactions that appear unauthorized, fraudulent, unlawful, or in violation of these Terms.
- You may not use stolen payment methods, attempt to evade payment, abuse trials or promotions, or initiate improper chargebacks.
- Payment providers may collect and process payment data under their own terms and privacy notices. We do not store full card numbers on our servers.
6. Acceptable Use
- Do not misuse the Service, including attempting to hack, disrupt, or reverse engineer it.
- Do not upload unlawful, infringing, or harmful content, or violate others’ rights.
- Do not use the Service to collect or store sensitive data about others without lawful permission.
- Do not use the Service for fraudulent, deceptive, abusive, or illegal transactions, or for any activity prohibited by our payment providers or applicable card network rules.
7. Your Content & License
- You retain ownership of content you submit (e.g., meal logs, photos, notes).
- You grant us a worldwide, non-exclusive, royalty-free license to host, process, and display your content solely to operate and improve the Service.
- You represent that you have the rights to submit the content you upload.
- We may remove content that violates these Terms or the law.
8. AI Features
- The Service may use AI to recognize foods and estimate nutrition. Results can be uncertain and may evolve as models improve.
- Do not rely on AI outputs as professional or authoritative advice.
9. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect and use personal data.
10. Third‑Party Services
The Service may integrate with or reference third‑party services and content. We do not control and are not responsible for third‑party services; your use is subject to their terms.
11. Intellectual Property
The Service, including software, designs, text, and trademarks, is owned by us or our licensors and is protected by law. Subject to these Terms, we grant you a limited, revocable, non‑transferable, non‑exclusive license to use the Service for personal, non‑commercial purposes.
12. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM OR USD $100, WHICHEVER IS GREATER.
14. Indemnification
You agree to indemnify and hold us harmless from claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service or your violation of these Terms or applicable law.
15. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the Service. Upon termination, provisions that by their nature should survive will survive (e.g., intellectual property, disclaimers, limitation of liability, indemnification, and governing law).
16. Changes to the Service or Terms
We may update the Service and these Terms from time to time. We will provide notice of material changes as required by law. Continued use after changes means you accept the updated Terms.
17. Export & Sanctions
You may not use the Service if you are subject to trade sanctions or in jurisdictions where using the Service would violate applicable export laws.
18. Governing Law & Dispute Resolution
These Terms are governed by the laws of Singapore, without regard to conflicts of laws rules. Subject to any rights you may have under applicable consumer protection laws, you agree that disputes arising from or relating to these Terms or the Service will be submitted to the courts of Singapore.
19. Miscellaneous
- Severability: If any provision is unlawful or unenforceable, the rest remain in effect.
- No Waiver: Our failure to enforce any right is not a waiver of it.
- Entire Agreement: These Terms constitute the entire agreement between you and us regarding the Service.
- Assignment: You may not assign your rights or obligations without our prior written consent.

These Terms apply to the Service operated by DAOWEI NETWORK TECHNOLOGY PTE. LTD. If mandatory consumer protection laws in your location provide additional rights, those rights are not limited by these Terms.
